Death Penalty Cases - Notice to Appellate Courts

If a criminal defendant is charged with capital murder and the county or district attorney files written notice pursuant to K.S.A. 21-4624 that such attorney intends, upon conviction of the defendant, to request a separate sentencing proceeding to determine whether the defendant should be sentenced to death, the clerk of the district court shall forward a copy of that written notice to the clerk of the appellate courts within seven (7) days after filing.
