Kansas Supreme Court Selected Opinion Summaries - December 6, 2002

Summaries and press releases are prepared by Ron Keefover, Office of Judicial Administration, Kansas Judicial Center, 301 West 10th, Topeka, KS 66612-1507 (785-296-2256), e-mail: keefoverr@kscourts.org.

The Supreme Court today filed 26 opinions. The full text of these decisions may be found at www.kscourts.org.

Appeal Nos. 88,264, 88,265, 88,266, and 88,575: State v. Dale C. Armbrust, Brian B. Thompson, Theresa Brown, and Timothy Baumann

The court, in a unanimous decision authored by Justice Donald L. Allegrucci, upholds the constitutionality of a statute making it a felony for a convicted sex offender to not provide mandatory periodic address verification even though violation of the statute was a misdemeanor at the time the defendants were convicted of their offense. (Each of the defendants' convictions occurred prior to 1999 when the legislature enhanced the penalty from a misdemeanor to a felony, something the trial court reasoned represented an unconstitutional violation of the Ex Post Facto Clause of the United States Constitution.) Unanimous, reversing and remanding with directions to Shawnee County District Court.

Appeal No. 86,523: William Edgar Wendt v. University of Kansas Medical Center et al.

The court, in a unanimous decision authored by Justice Donald L. Allegrucci, affirms findings in favor of the defendants in a Wyandotte County suit alleging retaliatory employment discharge.

Appeal No. 89,228: In Re: Stanley L. Wiles

The court imposes censure in an uncontested proceeding in discipline against a Kansas City, MO, attorney who is licensed to practice law in Kansas based on his representation in a personal injury matter.
